Successful Institution of Inter Partes Review and Stay of Litigation on Behalf of Prong Inc.

Pearl Cohen’s New York office  successfully petitioned the Patent Trial and Appeals Board (PTAB) to institute an Inter-Partes Review (IPR) of a patent being asserted in district court litigation against Pearl Cohen’s client Prong, Inc. The patent now under review, U.S. Pat. No. 8,712,486, generally relates to a cell phone case with an integrated charger and A/C prongs. In instituting the IPR, the PTAB determined that “there is a reasonable likelihood that Petitioner would prevail in challenging” nearly all the claims of the patent. The PTAB is scheduled to complete its review by December 2016. In addition, the filing of the IPR petition by Pearl Cohen convinced the district court judge to stay the litigation pending the outcome of the IPR, another favorable result for the client.
